Terms of Service

Welcome to WhatStatHD! These Terms of Service ("Terms") govern your use of the WhatStatHD mobile application (the "App") operated by Cr8ve Space and CareeRocket ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Service

WhatStatHD is a mobile application that allows users to:

Compress videos and images for sharing on WhatsApp Status
Edit media files (trim, crop, adjust quality)
Convert images to video format
Add background music to compressed videos
Split videos into multiple parts

2. Subscription Plans

2.1 Free Tier

The free version includes:

All compression and editing features
5 compressions per week
Advertisements before and after compression
WhatStatHD watermark on compressed media

2.2 Premium Tier

Premium subscription includes:

All features without limitations
Unlimited compressions
No advertisements
No watermark on compressed media
Priority customer support

2.3 Bonus Compressions

Free users can earn additional compressions by watching rewarded video advertisements. Each rewarded ad provides 3 bonus compressions.

3. Payment Terms

            Payment Processing: Payments are securely processed through Paystack, Apple App Store (In-App Purchases), and Google Play Store. We do not store your credit card or bank account details.
        

3.1 Subscription Fees

Prices are displayed before purchase on each platform
Subscription fees are charged in your local currency, pegged to USD
Subscriptions automatically renew unless cancelled
Apple App Store: Billed through your Apple ID in your local currency
Google Play Store: Billed through Google Play in your local currency
Paystack: Available for supported African currencies

3.2 Billing Cycle

Monthly: Billed every 30 days from subscription date
Yearly: Billed every 365 days from subscription date

3.3 Cancellation

You may cancel your subscription at any time
Cancellation takes effect at the end of the current billing period
You retain premium access until your current period expires
No refunds are provided for partial billing periods
Apple App Store: Manage and cancel subscriptions through your Apple ID settings
Google Play Store: Manage and cancel subscriptions through Google Play subscription settings
Paystack: Cancel through the App or by contacting us at hello@cr8ve.space

3.4 Refunds

Refund policies vary by payment platform:

Apple App Store: Refunds for App Store purchases are handled by Apple in accordance with Apple's refund policies. To request a refund, visit Apple's Report a Problem page.
Google Play Store: Refunds for Google Play purchases are handled by Google in accordance with Google Play's refund policies. To request a refund, visit the Google Play Store.
Paystack: Refunds may be provided at our discretion for technical issues that prevent use of the service, duplicate charges, or unauthorized transactions. To request a refund, contact us at hello@cr8ve.space within 7 days of the charge.

4. Acceptable Use

You agree NOT to use the App to:

Process or share illegal content
Infringe on intellectual property rights of others
Distribute malware or harmful content
Circumvent any technical limitations of the App
Share your subscription with others
Reverse engineer or modify the App
Use automated systems to access the App

5. Intellectual Property

5.1 Our Property

The App, including its design, code, features, and content, is owned by Cr8ve Space and CareeRocket and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our code or design assets. You may not redistribute, resell, or make the App available on any third-party platform or app store without our written permission.

Nothing in these Terms prevents you from independently developing your own application that offers similar functionality, provided it does not use our source code, design assets, branding, or any proprietary materials.

5.2 Your Content

You retain all rights to the media files you process using the App. We do not claim any ownership of your content.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

The App will meet your specific requirements
The App will be uninterrupted, timely, secure, or error-free
The quality of compressed media will meet your expectations
Any errors in the App will be corrected

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of data, profits, or business opportunities
Any damages arising from your use or inability to use the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless Cr8ve Space, CareeRocket, and their affiliates from any claims, damages, losses, or expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Content you process through the App

9. Modifications to Service

We reserve the right to:

Modify or discontinue any feature of the App
Change subscription prices (with notice)
Update these Terms at any time

Continued use of the App after changes constitutes acceptance of the new Terms.

10. Termination

We may terminate or suspend your access to the App:

For violation of these Terms
For fraudulent or illegal activity
At our sole discretion with reasonable notice

Upon termination:

Your subscription will be cancelled
You lose access to premium features
No refunds will be provided for termination due to violation

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

Informal Resolution: Contact us first to attempt to resolve the issue amicably
Mediation: If informal resolution fails, the dispute may be submitted to mediation
Arbitration: Final disputes shall be resolved by binding arbitration in Lagos, Nigeria

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App.

15. Third-Party Services

The App uses the following third-party services. By using the App, you also agree to the terms and policies of these services:

Paystack: Payment processing (Compliance)
Apple App Store: In-App Purchase and subscription billing (Terms and Conditions)
Google Play Store: In-App Purchase and subscription billing (Terms of Service)
Google AdMob: Advertising for free-tier users (Ads Policy)
Firebase: App performance monitoring, crash reporting, and cloud services (Terms of Service)
Google Analytics: Usage analytics and app performance insights (Terms of Service)
